These Terms of Service ("Terms") govern access to and use of the Horyzun website, services, reports, reviews, analyses, certifications, and related deliverables (collectively, the "Services").

By accessing our website, requesting a pilot, submitting content for review, or engaging our Services, you agree to these Terms.


1. About Horyzun

Horyzun provides multilingual publish assurance services intended to help organizations identify translation risks, terminology inconsistencies, meaning drift, constraint violations, and related publication concerns before content is released.

Our Services may include:

  • Translation review
  • Meaning risk analysis
  • Terminology governance
  • Constraint validation
  • Back-translation review
  • PublishSafe reports
  • Approval records
  • Review recommendations
  • Audit documentation
  • Related consulting services

Horyzun does not provide legal advice, regulatory advice, accounting advice, or professional certification recognized by any governmental authority.


2. Client Responsibility

Clients remain solely responsible for:

  • All content submitted to Horyzun
  • Publication decisions
  • Legal compliance
  • Regulatory compliance
  • Product claims
  • Marketing claims
  • Consumer disclosures
  • Localization decisions
  • Final approval of released content

Use of our Services does not transfer responsibility for publication decisions to Horyzun.


3. Nature of Deliverables

Reports, analyses, recommendations, approval records, and PublishSafe deliverables are provided for informational and operational decision-support purposes.

No report, recommendation, review, or approval should be interpreted as:

  • Legal certification
  • Regulatory certification
  • Government approval
  • Legal opinion
  • Guarantee of compliance
  • Guarantee of translation accuracy
  • Guarantee of business outcomes
  • Guarantee against claims, disputes, penalties, or losses

4. No Warranty

Services are provided on an "as-is" and "as-available" basis.

To the fullest extent permitted by law, Horyzun disclaims all warranties, including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy
  • Completeness
  • Reliability
  • Availability

While we strive to identify meaningful risks and inconsistencies, no review process can guarantee the absence of errors.


5. Limitation of Liability

To the maximum extent permitted by law:

Horyzun and its owners, employees, contractors, affiliates, and representatives shall not be liable for any indirect, incidental, consequential, punitive, special, or exemplary damages arising from use of the Services.

This includes damages related to:

  • Translation errors
  • Publication decisions
  • Regulatory actions
  • Litigation
  • Lost profits
  • Lost revenue
  • Business interruption
  • Reputation damage
  • Data loss

In all circumstances, Horyzun's total liability shall not exceed the amount paid by the client for the specific Services giving rise to the claim.


6. Intellectual Property

Clients retain ownership of content submitted for review.

By submitting content to Horyzun, the client grants Horyzun a limited license to:

  • Access
  • Process
  • Analyze
  • Review
  • Store temporarily
  • Produce deliverables

solely for providing the Services.

Horyzun retains ownership of:

  • Methodologies
  • Frameworks
  • Templates
  • Internal processes
  • Software
  • Documentation structures
  • Analytical models

unless otherwise agreed in writing.


7. Confidentiality

Horyzun will treat client materials as confidential and will not intentionally disclose confidential information to third parties except:

  • As required by law
  • With client authorization
  • To service providers necessary for operating the business under confidentiality obligations

Clients should avoid submitting highly sensitive information unless specifically requested and agreed upon.


8. AI-Assisted Processing

Horyzun may utilize artificial intelligence systems, machine learning models, automated review tools, and third-party processing services as part of its workflow.

Such systems may assist in:

  • Translation review
  • Risk identification
  • Segmentation
  • Terminology extraction
  • Quality analysis
  • Draft generation

Human review may be incorporated depending on the purchased service tier and engagement scope.


9. Service Levels and Timelines

Any stated turnaround times, service levels, pilot ranges, or review estimates are targets only and are not guaranteed unless explicitly included in a written agreement.

Delays may occur due to:

  • Scope changes
  • Content complexity
  • Technical issues
  • Volume fluctuations
  • Third-party dependencies

10. Payment

Fees are due according to the agreed proposal, invoice, or engagement terms.

Failure to pay may result in suspension or termination of Services.

Unless otherwise stated:

  • Fees are non-refundable once work has commenced.
  • Taxes are the client's responsibility.

11. Termination

Either party may terminate an engagement at any time.

Upon termination:

  • Outstanding fees remain payable.
  • Access to incomplete deliverables may be suspended.
  • Confidentiality obligations survive termination.

12. Governing Law

These Terms shall be governed by and interpreted under the laws of the State of California, without regard to conflict-of-law principles.


13. Changes to These Terms

Horyzun may update these Terms from time to time.

Updated versions will be posted on the website with a revised effective date.

Continued use of the Services constitutes acceptance of updated Terms.
